Purtill Denied

Bonita Purtill appeared at the Court of Appeal in Toronto Tuesday afternoon.

There will be no appeal trial for Bonita Purtill.

The woman convicted of killing four month old, Alexander Fleming, in an impaired driving collision Thanksgiving weekend 2008 was denied an appeal hearing on Tuesday.

At the Court of Appeal, Purtill's lawyer argued her sentencing should have been four years plus one instead of the seven she was given.

The defence say the trial judge did not give a proper explanation for the sentencing that was handed over.

The appeal was denied on the grounds that the defence could not prove there was an error by the trial judge, saying that Justice Kelly Gorman's sentencing was fair.

Purtill, who was not present in court on Tuesday, is eligible for early parole one year from now.

In speaking with Baby Alex's mother Mary Rodrigues Tuesday evening, she said "If I could scream from the mountain tops how happy I am, I would.  I am very pleased that the Appeal Court agreed with Justice Gorman's original sentence."
