Did she or didn't she? That's the question many are wondering after videos shown in court today of Terri-Lynne McClintic's confession to police. Jurors watched as McClintic described to police how Michael Rafferty killed Tori Stafford on May 24th, 2009. But this week, McClintic has told the court, under oath, it was her that wielded the murder weapon. McClintic was given the opportunity today to privately review her statement to police, and was asked again, and she is not changing her testimony. She says she was the one that killed Tori. She blames the inconsistency on the fact she didn't want to believe she had committed the murder, and that she thought Rafferty might commit a similar crime on another child. Heart FM Reporter Blair Wilson explains what the judge has instructed of the jury, as it relates to the conflicting evidence. "Superior Court Justice Thomas Heeney laid down the law pertaining to the inconsistencies in the video of Terri-Lynne McClintic. The jury cannot use the video as evidence. Heeney says the only evidence they can use is her testimony on the witness stand, here at the London Courthouse." But the jury can use the video to determine McClintic's credibility as a witness. Court has adjourned for day number 8, and the second week of the trial. It will resume Tuesday with more legal housekeeping. The jury not coming back until Wednesday. Once again, McClintic will be on the stand next week.
