If you are driving and have a cellphone in your hand, Ontario's top court says you're breaking the law.
In two decisions released yesterday, the Court of Appeal for Ontario ruled the phone doesn't need to be transmitting and it doesn't matter how briefly it's in a driver's hand.
In one case, a woman argued she`d just picked up her cellphone after it fell on the floor of her car when a police officer spotted her holding it.
In the other case, a man caught driving with a cellphone in his hand argued the Crown couldn't prove it was capable of sending or receiving at the time.
