The Father will have to wait until Feb. 8 for the next hearing, or get vaccinated in order to see his 12 year old child.
QUEBEC - A judge in Quebec has temporally suspended a fathers right to see his child based on vaccination status.
In a decision published on December 23, Superior Court Justice J. Sébastien Vaillancourt made the ruling that continue visitation was not in the best interest of the 12 year old child. The Judge argued that given the state of the pandemic, it was not in the best interest of the 12 year old or the child's younger have siblings.
The man told the court he follows the guidelines and does not leave his house. The court argued that Facebook posts showed the man is a conspiracy theorist and it was reasonable to believe he does not follow public health guidelines.
The argument from the court was given the spread of the Omicron variant, it was not a good idea for the 12 year old to visit his unvaccinated father and possibly bring COVID-19 home to his half siblings, who are not old enough to be vaccinated.
The next hearing is set for February 8 and the man was told he could se his children sooner, if he got vaccinated.
