The Ontario Appeal Court has ruled in favour of a London man who wants his lawsuit against Woodstock Police to proceed.
WOODSTOCK - A drug arrest by the Woodstock Police 5 years ago will be put under the micro-scope.
London's Everton Brown filed a lawsuit worth 2 million dollars claiming hardships in relation to his arrest. He was arrested on February 13, 2013 for possession for the purpose of trafficking crack cocaine and resisting arrest. His charges were withdrawn on October 22, 2015 and civil action was launched on May 13th, 2016.
Initially Brown's claims were contested because he filed 2 years after his arrest.
The Ontario Appeal Court has ruled the lawsuit against Woodstock police and four of it's officers and Brown's appeal can move forward. He is seeking $2 million dollars in damages, claiming false arrest, false imprisonment and breach of charger rights.
The OAC ruling stated that Brown is entitled to his costs on the appeal in the agreed amount of $10,500, and costs on the motion in the agreed amount of $12,000, both amounts inclusive of taxes and disbursements.
