The Supreme Court of Canada has sided with Oxford County and dismissed an appeal by Blandford Square Developments Limited.
WOODSTOCK - The Supreme Court of Canada has sided with Oxford County and dismissed an appeal by Blandford Square Developments Limited.
Blandford was upset with the County after they expropriated the old Blandford Mall back in 2005 and sold it to Toyota Manufacturing North America Inc. Toyota needed the land to build a new manufacturing plant and had their eyes on 1,000 acre lot in Woodstock which had 28 separate properties.
Oxford started the process of acquiring the lands back in 2005 with the holder of the first and second mortgage Vincorp Financial. The County negotiated the purchase of 27 of these parcels of land but was unable to negotiate the mall land. Oxford then took the necessary steps to expropriate those lands and transferred the 1,000 acres including the mall lands to Toyota. The deal for the mall lands was $4.2 million and Oxford offered the money to Blandford as compensation for the expropriated mall lands. Blandford felt the mall was worth more than that and initially filed a lawsuit through the Ontario Superior Court which they lost.
Then this week it was announced they lost their appeal of that decision through the Supreme Court of Canada and that Oxford County acted lawfully during the entire process. CAO of Oxford County Peter Crockett tells Heart FM they are happy to put this behind them. "It's great to have that whole issue settled out and now we can get on with the evaluation of the property and close out the whole thing.
