Court Decision

After nine years a judgement has been handed down in the case of Vincorp Financial vs the County of Oxford.

When it comes to the expropriation of the former Blandford Square Mall, the Ontario Superior Court of Justice has found Oxford County did nothing wrong. 

Back in February of 2005 the County started acquiring 28 properties to allow for the development of the Toyota Plant in Woodstock. While the County negotiated to purchase 27 of the properties, the former mall was expropriated. 

The former mall property owner, Blandford Square Developments and their mortgage holder Vincorp Financial alleged that the transfer of the mall lands was unlawful and without jurisdiction and that the land transfer conferred a bonus on Toyota contrary to the Municipal Act and as a result they believed the County was liable for damages. 

Justice C. Horkins ruled no bonus was conferred on Toyota as a result of the land acquisition and transfer by the County.

Blandford Square Developments now has 30 days to appeal.
