Michael Rafferty denied Legal Aid for appeal for the fifth time
Michael Rafferty has been denied Legal Aid for the fifth time.
The Attorney General of Ontario will now be forced to pay for Rafferty's first degree murder appeal in the death of Tori Stafford.
Last month Appeal Court Justice Marc Rosenberg ruled that Rafferty's case was too complex for him to handle on his own with the assistance of duty council and it was in the interest of justice that his appeal go back to Legal Aid for a fifth time and if denied, have the government pay for it through the Attorney General's office.
One of the items in the appeal states the trial judge should have offered the option that Rafferty be found guilty of being an accessory after the fact.
