A lawyer representing Rafferty seeks funding for his appeal
The Ontario Court of Appeal is reserving its decision on whether or not Michael Rafferty will get a taxpayer funded appeal on his murder conviction.
This morning, a Lawyer representing Rafferty argued an appeal would have merit. Paul Calarco argued that the judge should have given jurors the option to consider Rafferty was an accessory to the murder of Tori Stafford.
Calarco says Rafferty should get a publicly funded appeal, because the case is too complex for Rafferty to do by himself.
The appeal court judge has the options of dismissing the motion, request Legal Aid fund a lawyer, or order the Ministry of the Attorney General pay for the appeal.
Rafferty is serving a life sentence in a Quebec prison.
